Insurance Company Addresses of Where to Send Bail Bond Forfeiture Notices
A Notice of Bail Bond Forfeiture Notice is sent to an insurance company and the bail bonds company who wrote the bond when someone has absconded. If a defendant on cash bail fails to appear in court or violates conditions of their bail agreement, the court may choose to forfeit the bond. This means that the bail bondsman must pay the total bail amount to the court.
Bail forfeiture simply means that you will lose any cash paid for your bail bond and the defendant will be returned to jail. This will cause you to need to get another bond to get the defendant released. When this happens the bond company will need to notify the insurance company of the bail bond forfeiture notice.
Bail Cost Example: If bail was set at $10,000, the defendant would pay a bail bondsman $1,000 (the premium). What most people don’t realize is that the bondsman must pay the insurance company a portion of the premium.
If the defendant fails to show up to court or violates the court conditions while out on bond, the court will file a warrant for the defendant and will also issue the bondsman a Notice of Bail Bond Forfeiture.
Typically the bondsman has a certain period of time to find the defendant (now a fugitive) and bring them to jail to satisfy the order. If the bondsman cannot bring the fugitive to justice within a certain time frame, the bondsman then owes the court the full amount of the bond, in this example the entire $10,000. As an example, this is what happens in Brown County Texas when it comes to bail bonds forfeitures.
